Venezuela TPS Extended – What You Must Know

The Department of Homeland Security (DHS) has officially announced an 18-month extension of Temporary Protected Status (TPS) for Venezuela, offering continued relief and stability for Venezuelan nationals who cannot safely return to their home country. This extension is effective through October 2, 2026, ensuring that those eligible can maintain their status and work authorization in the United States.

Here’s a breakdown of what this extension entails, key deadlines, and steps for Venezuelan TPS beneficiaries to take.

Re-registration Period for Current TPS Holders

To benefit from the TPS extension, eligible Venezuelan nationals must re-register during the designated period, which runs from January 17, 2025, to September 10, 2025. Here are the key details:

  1. Who Can Re-register?

    • Re-registration is open to individuals who previously applied for and were granted TPS under Venezuela’s earlier designations.

  2. How to Re-register?

    • Submit Form I-821 (Application for Temporary Protected Status) to U.S. Citizenship and Immigration Services (USCIS) within the re-registration period.

    • To continue working legally, beneficiaries must also file Form I-765 (Application for Employment Authorization) with the necessary fees or a fee waiver request.

  3. Pending Applications:

    • Applicants with pending TPS or Employment Authorization Document (EAD) requests from a prior registration period do not need to reapply. Their applications will be processed to reflect the extended expiration date of October 2, 2026.

Automatic EAD Extensions

DHS has implemented automatic EAD extensions to prevent gaps in employment authorization. Eligible EAD holders will receive an automatic extension of their work authorization through April 2, 2026, if their current cards display one of the following expiration dates:

  • September 10, 2025

  • April 2, 2025

  • March 10, 2024

  • September 9, 2022

Employers and beneficiaries should refer to the specific instructions in the Federal Register notice to complete Form I-9 properly.
