EB-1A green card for extraordinary ability
A green card you file for yourself. No employer, no job offer, and no labor certification.
Who the EB-1A fits
The EB-1A is permanent residence for people at the top of their field, and you file it for yourself. There is no employer, no job offer, and no labor certification, which removes the two things that make most employment green cards slow and leave you tied to one company.
In exchange it asks for more than the O-1A. The O-1A asks whether you are extraordinary. The EB-1A asks whether you have sustained national or international acclaim, and whether you are coming to keep working in the field where you earned it. The evidence overlaps heavily, which is why so many people build one case and file both.
- Researchers and engineers whose work is cited, licensed, or built on by others
- Founders and executives with a public record of results
- Athletes and coaches with international standing
- Artists and performers with critical recognition over time
- Anyone already holding an O-1 who has kept building since
You also have to show the work will substantially benefit the United States prospectively. In practice that is a statement of what you intend to keep doing here, backed by evidence that you are in a position to do it.
Sustained acclaim
The standard is a level of expertise placing you among the small percentage who have risen to the very top of the field. The word that does the most work is sustained. A single strong year is not the shape of this case; a record that holds up across time is.
You qualify either with a one-time major, internationally recognized achievement, or with evidence meeting at least three of these ten.
- Nationally or internationally recognized prizes or awards for excellence
- Membership in associations requiring outstanding achievement, judged by recognized experts
- Published material about you and your work, in professional or major trade publications or other major media
- Judging the work of others in your field, on a panel or individually
- Original contributions of major significance, scientific, scholarly, artistic, athletic, or business-related
- Authorship of scholarly articles in professional or major trade publications or other major media
- Display of your work at artistic exhibitions or showcases
- A leading or critical role for organizations with a distinguished reputation
- A high salary or other significantly high remuneration
- Commercial success in the performing arts
Where the criteria do not readily apply to your occupation, comparable evidence is allowed, the same provision the O-1A carries.
Three criteria, then the harder question
Meeting three criteria does not approve a petition. USCIS counts first, then makes a final merits determination, weighing the whole record to decide whether it shows someone at the very top of the field. The EB-1A is where that second step bites hardest, because the bar it measures against is the highest of any category on this site.
A record that comfortably carried an O-1A can meet three EB-1A criteria and still fail the final merits determination. That is not a contradiction; the two categories are asking different questions of the same evidence.
Which evidence carries the most weight
- Independent use of your work. Citations, licences, adoption by teams you have never worked with, or a method that carries your name. Influence you did not arrange is the strongest thing in this category.
- Letters from people with no stake in you. Independent experts who can describe your impact on the field carry more than close collaborators and former supervisors, who read as testimonials.
- Awards with a real selection process. Who else was eligible, who judged, and how many were chosen.
- A salary benchmarked properly. Against published data for your role, level and region, not against your own previous pay.
What rarely carries a case on its own: paid memberships, awards you entered, conference attendance, volume of publication with no citation behind it, and a long list of letters that all say the same thing.
How it is filed, and how long it takes
You file Form I-140 for yourself. If a visa number is available for your country and you are in the United States in valid status, you may be able to file Form I-485 to adjust status at the same time. If you are abroad, the case goes through consular processing instead.
Priority dates are the part nobody controls. EB-1 moves faster than most employment categories, though applicants charged to India and China have faced waits that other countries have not. The State Department publishes the current position monthly in the Visa Bulletin, and we check it against your chargeability before advising on timing.
Premium processing is available on the I-140 and commits USCIS to act within 15 business days. It speeds the petition, not the visa number, so it changes the timeline for some people and almost nothing for others.
Your spouse and unmarried children under 21 can be included as derivatives on the same case.
What it costs
Government filing fees are set by USCIS, change over time, and differ depending on whether you adjust status in the United States or process at a consulate. Legal fees are a flat fee quoted after your strategy session. Payment plans are available.
Because the EB-1A is self-petitioned, there is no employer to share the cost with. That makes it more expensive to you personally than a sponsored route, and independent of any job.
Three records we see often
The O-1 holder two years on
Someone who filed an O-1A, kept publishing or shipping, picked up judging work and a second round of press, and now has a record with time behind it. The evidence file is largely the same documents plus two more years, which is the cheapest EB-1A there is.
The industry researcher with citations outside the company
Few papers, but patents that other firms licence or cite, and a method that has been picked up beyond the employer. The case runs on original contributions of major significance, where independent adoption does the heavy lifting rather than citation count.
The coach or athlete with international standing
Results at an international level, national team involvement, press in the sport's own media, and selection or judging roles. Athletic contributions are named in the criteria, which people reading a list written for scientists often miss.
These are patterns, not case results. Every petition turns on its own record and its own evidence.
Questions people ask first
Do I need a job offer or an employer?
No. The EB-1A is self-petitioned. You file for yourself, with no job offer and no labor certification, and the green card is not tied to any employer.
How is the EB-1A different from the O-1A?
The O-1A is a temporary work visa that an employer or agent files for you. The EB-1A is permanent residence that you file for yourself, and it asks for sustained national or international acclaim rather than extraordinary ability at a point in time. The evidence overlaps enough that many people build one file and use it for both.
Can I file an EB-1A and an O-1A at the same time?
Yes, and it is common. Filing an immigrant petition is not on its own a reason to deny an O-1 or an extension.
How many criteria do I need?
At least three of ten, unless you hold a one-time major internationally recognized achievement. Meeting three is the first half of the test; USCIS then weighs the record as a whole in a final merits determination.
Does a low citation count rule me out?
No. Citation count is evidence of influence, not the only evidence of it. Patents that others licence, methods adopted outside your employer, and products built on your work can all show the same thing, and they matter more for people who have worked in industry rather than academia.
How long does it take?
The petition itself can be decided within 15 business days with premium processing. How long until you hold the green card depends on whether a visa number is available for your country, which the Visa Bulletin sets month by month and nobody can accelerate.
Not sure you qualify? That's what the first conversation is for.
We'll review your record, tell you which path fits and what's missing, and say so if now isn't the right time to file.
