TN status for Canadian and Mexican professionals
Work status under the USMCA. When your profession is on the list, it is among the fastest routes into the U.S.
Who the TN fits
The TN exists under the USMCA, the agreement that replaced NAFTA, and it is open to citizens of Canada and Mexico. Citizenship is the requirement, not residence: a permanent resident of Canada who holds another nationality cannot use it.
Where it fits, it is the fastest route in this list. There is no annual cap, no lottery, and for Canadians no petition at all. Where it does not fit, it does not bend, because the profession list is closed and the degree requirements attached to each entry are specific.
Professions on the list
The USMCA lists around sixty professions, each with its own qualification requirement. Engineer, Scientist, Accountant, Economist, Architect, Lawyer, Librarian, Management Consultant, Computer Systems Analyst, Graphic Designer, Hotel Manager, Teacher, and a long run of medical and allied health roles all appear.
Two entries attract far more scrutiny than the rest. Management Consultant is the one most often used to describe a job that does not really fit it, and officers know that. Computer Systems Analyst is frequently confused with general software engineering, which is not what the entry covers. If your role sits near either, the job description matters more than the job title.
The qualification is set per profession and is usually a specific degree. Engineer, for example, requires a baccalaureate in engineering or a state or provincial licence. A related degree is not the same thing, and this is where most refusals start.
How you get it
Canadians apply at a port of entry or a pre-clearance facility with the supporting documents in hand. There is no petition and no visa stamp. Approval is usually granted the same day, which is why the TN is the quickest status on this site to obtain and the easiest to get wrong, because the whole case is decided in one conversation with one officer.
Mexican citizens apply for a TN visa at a U.S. consulate first, then enter with it. The standard is the same; the process has an extra step.
Either way you need a pre-arranged position with a U.S. employer. Self-employment does not qualify, and an arrangement where you effectively control the employing company invites the same objection.
TN status is granted for up to three years and can be renewed in three-year increments, with no overall limit.
The catch worth knowing before you start
The TN requires nonimmigrant intent. You have to intend to leave when the work ends. It is not a dual intent status the way an H-1B is, which means pursuing permanent residence can put your next renewal or entry at risk.
That does not make the two incompatible, and plenty of people move from a TN to a green card. It does mean the sequence has to be planned rather than discovered at a border crossing. If permanent residence is the goal, say so at the strategy session and we will plan the order, which often involves moving to a different status before the immigrant petition is filed.
Which evidence carries the most weight
- An employer letter written to the profession. It should name the USMCA profession, describe duties that match that entry, and state the length of the engagement and the pay.
- Credentials that map exactly. The degree the entry requires, with an evaluation where the qualification is from outside the U.S. or Canada.
- A licence where the profession requires one. Several entries accept a state or provincial licence in place of a degree.
- Proof of citizenship. A passport. Permanent residence in Canada or Mexico does not qualify.
What causes trouble: job titles that sound more senior than the duties, descriptions written for a recruiter rather than for an officer, and a role that looks like general staffing rather than professional work in the listed field.
What it costs
This is the cheapest route on the site. For Canadians there is a fee at the port of entry and no petition. For Mexican citizens there is a consular visa fee. Legal fees are a flat fee quoted after your strategy session, and TN work is usually a preparation and document review engagement rather than a petition build.
Your spouse and unmarried children under 21 can hold TD status. TD carries no work authorization, which is the single most common surprise for families moving on a TN.
Two records we see often
The engineer with a near-miss degree
A software role with a computer science degree, applying as Engineer. The entry requires a baccalaureate in engineering, and computer science is often not accepted for it. The fix is usually a different listed profession or a different status, worked out before anyone drives to the border.
The consultant whose letter does the damage
A genuine management consultant whose employer letter describes ongoing operational duties. Management Consultant covers advisory engagements, not filling a permanent operational role, and a letter written loosely reads as the second. Rewriting the letter to match the work is most of the job.
These are patterns, not case results. Every application turns on its own facts and its own documents.
Questions people ask first
Do I need a petition for a TN?
Canadians do not. You present your documents at a port of entry or pre-clearance and the decision is usually made the same day. Mexican citizens apply for a TN visa at a U.S. consulate first.
How long does TN status last?
Up to three years at a time, renewable in three-year increments with no overall limit, for as long as the position and your qualifications continue to support it.
Can my spouse work on a TD?
No. TD status covers a spouse and unmarried children under 21, and it carries no work authorization. Families who need two incomes usually need to find separate status for the second earner.
Can I apply for a green card while on a TN?
The TN requires nonimmigrant intent, so pursuing permanent residence can affect your next renewal or entry. It is not impossible, and it is not something to improvise. Plan the sequence first.
Does being a permanent resident of Canada qualify me?
No. The TN is open to citizens of Canada and Mexico only. Permanent residence in either country does not qualify you.
My profession is not on the list. What now?
The list is closed, so the answer is a different route rather than an argument. Depending on your record that may be the O-1A, the EB-2 National Interest Waiver, or an employer-sponsored category.
Not sure you qualify? That's what the first conversation is for.
We'll review your record, tell you which path fits and what's missing, and say so if now isn't the right time to file.
